California is a unique state for motorcyclists due to its lane splitting law. Lane splitting refers to the practice of riding a motorcycle between lanes of traffic, in order for the motorcyclist to pass slower-moving traffic. Uninsured/Underinsured coverage is used when the at-fault party doesn’t have enough insurance to pay the full value of the case or when the other party doesn’t have any insurance, or if it is a hit and run and the other party is not identified.

Why is uninsured motorist insurance especially important for a motorcycle rider in California?

This insurance is critical. We see too many cases where we cannot get the full value of the case for our client because the at-fault party doesn’t have enough insurance or doesn’t have any insurance. I recommend riders carry at least $250,000 in uninsured/underinsured coverage. If you can’t afford that than get at least $100,000.

When do you send an investigator to the scene of my California motorcycle accident?

It varies. If it’s in an area where there are likely to be surveillance cameras, we will have our investigator canvas the area for video and potential witnesses. We often send our accident reconstruction expert to the scene to preserve the evidence.

You can but it won’t go anywhere. You should not sue the officer. There is no case there. Moreover, the officer’s conclusion as to fault is not admissible unless the officer saw the accident or is an accident reconstructionist and actually reconstructed the accident. The fact that an officer’s conclusion is not always correct doesn’t necessarily mean the case can’t be won. Approximately 70% to 80% of our traffic collision reports are against our client but we take the overwhelming majority of those cases, as we can usually find a valid theory of liability on the other party. For example, in splitting lanes cases the traffic collision report frequently has our rider traveling at an unsafe speed. In most of those reports there is no physical evidence, such as skid marks, to confirm excessive speed and even if there is some speed, the other driver still violated the rider’s right-of-way.

Can you help me file for disability after my motorcycle accident?

If you’ve been working at a job that takes taxes out and pays into State Disability, you may qualify for State Disability Insurance, assuming you will be out of work for an extended period. To qualify you must meet the work history requirement. Our clients have no problem doing this on their own on the EDD website on the SDI page. With respect to Federal Disability which requires a significant injury, we work with a disability lawyer.
