Unfair Discrimination against Motorcyclists – Will It End?
Motorcycle Attorney Blog; If you ride anywhere in the United States, you already know that motorcyclists don’t always get fair treatment—especially when it comes to the law. Now, that may be changing. 50 U.S. House members have recently signed a bill that would effectively bar the U.S. Transportation Secretary from providing funds that support motorcycle-only checkpoints. These checkpoints notoriously single out motorcyclists and unfairly discriminate against them.
The American Motorcyclist Association began first tracking these unfair motorcycle-only checkpoints back in 2007. Since then there have been many public motorcycle-only checkpoints cropping up all over the United States. In 2011, the State of Georgia conducted motorcycle-only roadside checkpoints when they realized that thousands of motorcyclists were traveling through their state en route to Daytona Bike Week in Florida. Later that year, another was conducted in North Virginia during Rolling Thunder’s highly profiled Memorial Day Demonstration.
Three states, however, have outlawed this discriminatory practice already—Virginia, North Carolina, and New Hampshire and other states, such as California, Illinois, Missouri, and New Jersey are introducing legislation to prohibit them as well.
Why single out motorcyclists for safety concerns? That is a big question that many are unable to answer. Motorists of all vehicles cause accidents, ride unsafely, and exhibit unsafe driving behavior, yet there are no “Minivan only checkpoints”. The very existence of such a program directly discriminates against a group of people—motorcyclists—and is considered profiling and discriminatory by nature.
If the new bill, H.R. 904, is passed, then this would be a huge step towards motorcycle equality and would help prevent these ultimately discriminatory practices from occurring in the future.

Have been subjected to them up on Long Island. They literally pulled an entire CHARITY ride off the LIE for “safety checks” to the point they were also pulling them off the opposing lanes and making them cut across the grassy median to get to the checkpoint. Cars flying by far exceeding the speed limit yet not a one of them pulled over. YES, it is profiling and very discriminatory.
Maybe when COPS start obeying their own laws, I’d have no problem being stopped at a check point. I have nothing to hide.
I’ve seen cops SPEEDING (not going anywhere for an emergency…followed ond STATE COP to his house which was down the road from where I worked…in excess of 10 mph over the limit on the interstate and through the city), driving with their cell phone stuck in their ear, driving with no lights on (law here states they must be on (a) when it is raining hard enough to use windshield wipers, (b) 1/2 hour after sun rise, (c) 1/2 hour before sunset. I was along side a city cop before the sun was up and he had no lights on and I blow my horn at him. He rolled his window down and I said, “Hey officer, your headlights don’t work.” He looked at me with a walking brain stem blank look, rolled his window up and drove off….with his headlights STILL off. When I came up behind him, I thought he had a rear lights fuse blown, then I noticed his head lights weren’t on. and (d) no turn signals (a moving violation for civilians).

We are also being discriminated against, with the Motorcycle Noise By-Law and it is spreading everywhere. the noise makes sure other drivers notice and be aware so not to hit the riders and biker are conserving energy so I think should be commended for their conservation and less negative impact on the Earth- don’t use near the fuel (maybe that’s part of the problem since so many with influence on the laws have so much tied up in oil…)
