An accident involving a motorcycle and two buses in the Lincoln Tunnel resulted in a lengthy traffic jam, stranding some motorists inside the tunnels for as long as four hours, with some lanes closed for up to eight hours. New York motorcyclists face risks every time they get on their bikes—especially when driving in the early morning hours. According to the New York Times, those risks may also include deadly hit and run accidents.

On January 10th, Dwan Gonzalenz was riding his Harley-Davidson eastbound on the Long Island Expressway, near Junction Boulevard, when he was hit by a Freeport man who was driving intoxicated. Officers later found the driver, arrested him, and charged him with driving while intoxicated, leaving the scene of an accident, and driving with a suspended license. One of the best things about my job working for Russ Brown Motorcycle Attorneys, is meeting some incredible people in the motorcycle industry.  One of those shining stars is Carmella Brown.  Many of you know Carmella.  She is the creator of New York Rider Magazine and can be seen at most of the major motorcycle events, not just in New York but all along the East Coast. 

I met Carmella at the International Motorcycle Show in New York City in 2009.  I knew as soon as I laid eyes on her that she was a force to reckon with.  We had a great time in New York City and have worked together at many events since then. 

What makes Carmella stand out?

Carmella is fierce about protecting bikers rights.  She goes to meetings, she goes to court hearings, she writes articles, she supports children charities, etc, etc.  Carmella is a doer.  When she was at the 13th Anniversary Catskill Mountain Thunder motorcycle celebration a fire broke out at the Blackthorne Resort.  Carmella ran straight over and started to help.  She found out that a group of young Romanians  who worked at the resort every summer lost everything in the fire.  Carmella immediately went into action.  She collected clothes, money and supplies for these kids from vendors and fellow bikers at the event.  She then took her truck and headed to Walmart to load up on additional supplies for the kids.  She explained the situation to the assistant manager at Walmart who gave Carmella 10% off the entire purchase.  Carmella did not stop there…

Carmella started making calls to New York attorneys to make sure these kids got their passports back.  

On Thursday, October 14th Carmella sent me an email with a link to www.syracuse.com.  It was a an article about Fred Salisbury, who at the age of 89, jumped from an airplane.  The article goes on to say that Fred Salisbury, a WWII paratrooper wanted to do something different and why not do it again.  Salisbury said it was a beautiful day to jump and reminded him of the time he served with the 87th Airborne, from 1944 to 1946.

Salisbury, who has two daughters, five grandchildren and 12 great-grandchildren, isn’t ruling out the possibility of jumping again. On Saturday he jumped with an instructor and his family watched as he made his way to the ground.

Fred Salisbury is Carmella Brown’s Grandpa. 

I had a huge smile on my face when I  finished reading the article because I could see where Carmella got her ‘balls’ from.

The NHTSA statistics only takes into account speed-related motorcycle crashes in which the driver was charged with speeding or a police officer indicated speeding was a factor.

Offering virtually no physical protection, motorcycles are inherently more dangerous than other vehicles. When motorcyclists speed, the potential danger increases. Maintaining bike control becomes more difficult at high speeds, especially for an inexperienced driver. Even when a helmet is worn, a high-speed collision between a motorcycle and another vehicle or stationary object can cause life-threatening injuries including traumatic brain injuries and spinal cord injuries.

Anytime a passenger vehicle or truck crashes into a motorcycle or scooter, the driver on two wheels is likely to be seriously injured or killed. The NY Daily News reported that on September 19, a New York teenager crashed her car into a scooter driven by a restaurant deliveryman. The 19-year old car driver was apparently responding to a text message while driving behind the scooter. The 53-year old man riding on the scooter suffered severe head trauma. He was declared brain dead and is currently listed in critical condition. The New York scooter accident occurred at the intersection of Avenue P and E. 17th Street in Brooklyn. Police charged the teen with reckless driving, which is a misdemeanor, and driving while using a mobile phone.

In 2009, New York passed a law making it illegal to text on cell phones and similar devices while driving. New York had already banned talking on cell phones when driving, with the exception of phone calls to emergency personnel. However, police officers cannot stop New York drivers just because they suspect illegal cell phone use. They must have another valid reason, such as a traffic violation, in order to stop a driver for using a cell phone. The New York Department of Motor Vehicles indicates the maximum fine for violating the cell phone law is $100 with an $80 mandatory surcharge.

Unfortunately, many New York drivers ignore the state cell phone law and horrible accidents occur as a result.
